Agreement

This document constitutes the contract between the above-mentioned parties.
Project Description:
The project is to create a website for David Gross’s communication 3224 class, its purpose to help promote a Life & Style magazine blog site for Ezme-LaLa (Esmeralda Gordillo), its function being to attain followers and exposure. The project includes research, programming, structural design, graphic design, and page production.
The website will be based on an existing WordPress theme to reduce costs and improve stability.
The website will include the following sections:
Culture & Diversity in: (Photography, media, videos & press resources will accompany if available)
-Life: Self care; wellness, relationships, & self improvement (quotes/motivations/spirituality)
-Food: Reviews, Critiques & food deals
-Style: Beauty/home/travel, & shopping-deals
-Entertainment/Recreation: photography/music/sports/pop culture
Stages of the Project:
The project will be complete in three stages.
1. Structure and Functional Design
a. Functionality of the website
b. Structure and content categories of website content
c. WordPress theme which will be adapted for the website
2. Graphic Design (visual design and adaptation of the WordPress theme)
3. Production (creation of pages with real content, including creation of graphic elements, videos, etc.)
Materials Supplied:
David Gross agrees to provide, as required:
- necessary artwork in a usable format (e.g. with transparency), including company logo designs
- approved text for the website
Schedule:
All work will be finished by March 16, 2017. Changes or delays by David Gross may change this deadline.
Payment Schedule:
The entire project as agreed will cost a letter grade of an A.
- David Gross agrees to give recommendations, comments & feedback upon approval of this contract.
- David Gross agrees to give 50% letter grade of the final project upon approval of the “Graphic Design” stage of the project.
- David Gross agrees to Give the remaining 50% letter grade totaling a letter grade of an A upon completion of the final website, on or before March 24, 2017.
Any additional work that exceeds more than 6 hours a week not previously agreed upon, professor David Gross must provide 3% extra credit to the grade. Esmeralda Gordillo may choose to charge an additional penalty fee to the final grade of a letter grade marked up for any late grading after the date of march 24, 2017.
Rights:
David Gross has full use rights to all software, graphic design, and writing created by Esmeralda Gordillo for this project.
All rights pertaining to software and design purchased for the project will be determined by the terms and conditions of California State University Eastbay’s Communication Department Guidelines.
Termination:
David Gross may terminate work at any time and agrees to the letter grade agreed upon above for all completed stages, and one-half of the current stage of work if it is in progress. For example, if David Gross terminates the project during the “graphic design” stage, David Gross will provide a final letter grade for the “structure and functional design” stage and one-half of the “graphic design” stage.
Jurisdiction:
The jurisdiction for disputes about this contract is the State of California.

COMM DESIGN CONTRACT

This document constitutes the contract between the above-mentioned parties.
Project Description
The project is to create a website/online-portfolio for Carlos Gomez for the CLIENT to grade, on the basis of its ability to help promote Carlos Gomez’s talents to potential employees, collaborators, funders, and clients. The project includes research, programming, structural design, graphic design, page production, and more as it heads to the final stage.
The website will be based on an existing WordPress theme to reduce costs and improve stability. The website will include the following sections:
- Home
- Videos (with subsections for each video)
- Writings (with subsections for each piece of writing)
- Photos (with subsections for each collection of photos/photo essays)
- Other Works (with subheadings of Doodles, and another labeled Comics, that each have subsections that lead to works pertaining to that type of medium)
- About Me (that leads to a subsection titled “Get In Touch” that leads to a contact form for users to contact Carlos Gomez)
Stages of the Project
The project will be complete in five stages:
- Initiation:
This section focuses on dealing with brainstorming sessions with CLIENT, the development of a PITCH LETTER and CONTRACT.
- Planning:
This section deals with finalizing a schedule, a budget, and deadlines between the CLIENT and DEVELOPER. MARCH 16TH is the date reached to finalize the project. (SEE PROJECT SCHEDULE for other dates relevant to the project).
- Execution:
This section revolves around handling the structure and functional design:
-Functionality of the website
-Structure and content categories of website content
-WordPress theme which will be adapted for the website
-Graphic Design (visual design and adaptation of the WordPress theme)
-Production (creation of pages with that showcase provided content, including creation of other graphic elements if needed to further supplement the website, etc.)
- Control
This section revolves around quality control of the entire website. DEVELOPER will make changes and approval from the CLIENT as this phase commences to finalize the website for desired use.
- Closing
In this section documentation and password sharing will be provided for CLIENT of the finalized website.

Payment Schedule
The entire project as agreed will cost the letter grade of an A/A+ (OR a lesser grade within the A-F grading system, based on critique that justifies grade) and $1,500 dollars.
CLIENT agrees to pay $500 upon approval of this contract.
CLIENT agrees to pay $500 will be paid upon approval of the “Graphic Design” stage of the project.
CLIENT agrees to pay the remaining balance of $500 within 7 days after acceptance of the final product (“production” stage).
Any additional work not previously agreed upon will be charged at $100/hr. Payments are due within 15 days of invoicing. DEVELOPER may choose to charge 1.8% per month interest penalty for late payments.
Rights
CLIENT has full use rights to all software, graphic design, and writing created by DEVELOPER for this project. All rights pertaining to software and design purchased for the project will be determined by the terms of those purchases.

I look forward to working with you in creating an attractive and useful website within the learning of our COMM 3224 course.
I understand that the purpose of this website is to appeal to potential clients, prospective collaborators and even investors. I want the site to be colorful, present with different types of content in video, photography, text, etc., and to display a playful personality throughout. It should be minimal — with a solid and useful design, that showcases my identity, creativity, and most importantly my work.
I’m excited to start working on an online portfolio, where you can see a curated presentation of my recent projects such as videos, writings and photos, as well as more works not as emphasized throughout my career but still can have a place within the website. I believe that the website should also provide social media links and a way to contact me for potential business in the future should also be accessible through this website. I want this site to act as a “modern business card” for myself, but where people can see my previous work to understand who I am creatively and contact me if they want to work with me.
I propose we create a WordPress website (so I can easily modify and maintain it). I estimate that I would require around 60 hours of work in total (which includes installation, graphic design, meetings, revisions, etc.). I offer to create the website for a project fee of an A.

Payment Schedule

- ClIENT agrees to pay compliments and feedback upon approval of this contract.
- CLIENT agrees to pay feedback and compliments upon approval of the “graphic design” stage of the project.
- CLIENT agrees to pay the student an A by March 27th (grades for winter quarter are due by this day)
Any additional work that exceeds 75 hours and/or work not previously agreed upon, the CLIENT will give extra credit. Payments of such are due within 11 days of final completion of the project. DEVELOPER may choose to charge an additional to 3% to the final grade the CLIENT assigns.
Rights
DEVELOPER has full use rights to all software, graphic design, and writing created by DEVELOPER for this project. All rights pertaining to software and design purchased for the project will be determined by the terms of those purchases.
Termination
CLIENT may not terminate work at any time. This is for a grade in a class and CLIENT cannot terminate work from DEVELOPER. The closest thing to termination a CLIENT can do is halt the project and push back the due date.
Jurisdiction
The jurisdiction for disputes about this contract is the Cal State East Bay Communications Department.
